What Does “Registration as a British Citizen” Mean?
Registration is the legal process through which a person who is not automatically British may acquire British citizenship if they meet the statutory requirements.
Unlike naturalisation, which is usually based on residence and immigration status, registration often arises from birth in the UK, parental nationality or immigration status, long residence from childhood, historical nationality anomalies, and entitlement under specific provisions of the British Nationality Act 1981.
This route is particularly common for children under the age of 18.
Registration for a Child Born in the UK
Whether they acquire citizenship automatically depends on the parents’ immigration status at the time of birth.
For example, a child may be eligible to register if, after or beofre their birth, one parent is or becomes a British citizen, obtains Indefinite Leave to Remain (ILR), obtains settled status under the EU Settlement Scheme, or acquires permanent residence status.
If the child is under 18, they may usually apply using Form MN1.
Registration After 10 Years of Residence
A child born in the UK may also have an entitlement to register as British after living in the UK for the first 10 years of their life, even if neither parent was settled or British at the time of birth.
This route generally requires that the child was born in the UK, lived in the UK for the first 10 years, and absences did not exceed 90 days in each year.
Registration for Children Born Outside the UK
Children born abroad may also be eligible in certain circumstances, including where one parent is British and the relevant statutory requirements are met.
The precise legal route depends heavily on the facts and requires careful legal assessment.
Documents Commonly Required
The supporting documents will depend on the specific route, but commonly include:
full birth certificate
parents’ passports
evidence of parents’ immigration status
proof of continuous residence
school letters
tenancy agreements
travel history and absence records
parental consent documents
The evidence must clearly demonstrate eligibility.
Good Character Requirement
Applicants aged 10 or over are generally subject to the good character requirement.
The Home Office may consider criminal convictions, cautions, immigration breaches, and previous issues involving deception.
